      Present: Mr. Daniel Brady, Mr. David Snow, Ms. Irene Hegedus- in at 7:00 PM, Mr. John Busta.

Richard Sarafan, Esq. gave instructions to the applicants regarding the vote since there were only Three members of the Board present at this time.

      Ms. Irene Hegedus arrived at 7:00 PM.

      Motion to approve subect to Staff’s recommendations made by Ms. Irene Hegedus, Seconded by Mr. David Snow and the Motion passed 4-0.

      Motion to approve subject to Staff’s recommendations with the condition that the shelves remain below the window sill made by Mr. Daniel Brady, Seconded by Ms. Irene Hegedus and the Motion passed 4-0.

    2. PZ-9-13-18-67 577 NE 96th Street, One LA LA Land LLC (Owner), (Agent) Victor Bruce; Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations and Sec. 600. Site plan review and approval required, for a 1400 square foot exterior addition to an existing home to add a cabana and outdoor kitchen area.

      Staff recommendation is for denyal.

      There was extensive discussion by the Board regarding the application. There was question about what the Historic Preservation Board had approved.

      Section 11-4 c, d of the Code was read in by the Village Attorney, Mr. Richard Sarafan.

      For the record there was no one present from the Historic Preservation Board.

      Motion to approve subject to Staff’s recommendations with the additional condition to recess the outdoor kitchen to the front elevation back beyond the existing historic arch way, secondly a restricted covenant to keep this property as a single family property, thirdly to match the finish on the new structure to the old structure made by Mr. David Snow, seconded by Ms. Irene Hegedus and the Motion failed 2-2.

      Motion to approve subject to Staff’s recommendations with additional condition that the finish match the existing structure, a covenenat for a single family residence and with the elevation as it shows with all of the elements of the existing structure being matched made by Ms. Irene Hegedus, seconded by Mr. Daniel Brady and the Motion passed 3-1 with Mr. David Snow voting against it.

      To clarify the Motion; the finishes, the collums, architectural elements that defines the historic property need to be preserved.

    3. PZ-9-13-18-68 899 NE 92nd Street, (Applicant) Carlos Abaca, (Agent) Harry Sanchez; Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations, Sec. 504. (f), (g) (2) and Sec. 600. Site plan review for a 3500 sq foot 1 story house.

      The Board opined that the proposed had a wearhouse look.

         Public Comment open:

              1. Cardina Arronte, the owener of the house across the street. She states that she likes Miami Shores because of the home feeling. She is in total disagreement with the proposed plans for this property which in her opinion looks like a wearhouse. Miami Shores has a sense of community and this boxy schetch does not match. This will affect the value of the surrounding homes. It is not harmonious with the surroundings.

              2. Mr. Garrett Shaper who lives at 905 NE 92 Street. He has only head from his neighbors about the new construction. He does not agree with the proposed drawings of this application. It is not in harmony with the surrounding area.

         Motion to Deny the application made by Mr. Daniel Brady, Seconded by Ms. Irene Hegedus and the Motion passed 4-0.

    1. PZ-9-13-18-69 50 NE 91st Street, (Applicant) Robert Cepero (Agent) Dan Robertson; Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations, Sec. 504. (f), (g) (2) and Sec. 600. Site plan review for a garage conversion for a closet and laundry room.

      Motion to approve subject to Staff’s recommendations with the added covenant that the home remains a single family home made by Mr. Daniel Brady, Seconded by Ms. Irene Hegedus and the Motion passed 4-0.

    2. PZ-9-13-18-70 Folio Number 11-3206-013-3940, (adjacent to 271 NE 95th street to the west) Mtinez investments group II, LLC, Robaisy Martinez (Owner), (Agent) None; Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations and Sec. 600. Site plan review and approval required, for a new 2500 square foot single family residence.

      Public Hearing Now Open:

              1. Ms. Tracy Britton, who resides at 271 NE 95 Street – Asked to take a look at the plans, she did. She testified that her neighbors are very nice people and all the homes have very different styles. Each house being very unique.

       Public Hearing Now Closed.

            The applicant asked for some input as to how to desing the house to make it look different. The Board recommended to get with the Architec to come up with a different design.

       Motion to approve subject to Staff’s recommendations with a covenant for the Septic tank to be relocated in the front of the house made by` Mr. Daniel Brady, amended by Ms. Irene Hegedus to add a window in the Foyer, Seconded by Ms. Irene Hegedus and the Motion passed 4-0.

PZ-9-13-18-71 Folio Number 11-3206-013-3930, (adjacent to 271 NE 95th street to the west) Mtinez investments group II, LLC (Owner), (Agent) None; Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations and Sec. 600. Site plan review and approval required, for a new 2500 square foot single family residence.

      Motion to Table until next hearing by Mr. David Snow, Seconded by Mr. Daniel Brady and the Motion passed 4-0.
