        1. April 26, 2018

          Motion to approve the minutes of April 26, 2018 by Mr. Brady, seconded by Mr. Snow and the vote was unanimous in favor of the Motion.

      2. TABLED ITEMS

        1. PZ-4-26-18-31 : 123 NW 109th Street, (Owner) Marie Bobo, has filed an application for site plan review before the Planning Board on the above property. The applicant seeks approval: Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations and Sec. 600. Exterior renovation (entry feature).

          Motion to lift from tabled items by Mr. Brady, seconded by Mr. Bergman and the vote was unanimous in favor of the Motion.

          Motion to approve subject to Staff’s recommendations by Mr. Snow, seconded by Mr. Brady and the vote was unanimous in favor of the Motion.

        1. PZ-5-24-18-36 9632 NE 5th Avenue Road, David Halabu (Owner), has filed an application for site plan review before the Planning Board on the above property. The applicants seek approval: Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations and Sec. 600. Site plan review and approval required, for a 900 square foot renovation and addition, including a second floor.

          Motion to approve subject to Staff’s recommendations, with a covenant that the declaration of use is assuring the property is only used for single family purposes, the owner will be required to record this covenant with Miami Dade County and provide a copy to Staff prior to final inspection by Mr. Snow, seconded by Ms. Hegedus and the vote was unanimous if favor of the Motion.

        2. PZ-5-24-18-37 490 NE 91st Street Miami Shores FL 33138, Salvator Cavallaro (Owner), has filed an application for site plan review before the Planning Board on the above property. The applicants seek approval: Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations and Sec. 600. Site plan review and approval required, for an addition.

          Motion to approve subject to Staff’s recommendations with a condition that the windows throughout the house remain with uniformity by Mr. Brady, seconded by Ms. Hegedus and the vote was unanimous in favor of the Motion.

        3. PZ-5-24-18-38 1481 NE 104th Street, James Breen (Owner), (Agent) Robert Rossi; Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations and Sec. 600. Site plan review for a dock and boatlift.

          Motion to approve subject to Staff’s recommendations by Ms. Hegedus, seconded by Mr. Snow and the vote was unanimous in favor of the Motion.

        4. PZ-5-24-18-39 148 NW 97th Street , (Applicant) Gustavo Arcia, (Agent) Callum Gibb; Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations, Sec. 504. (f), (g) (2) and Sec. 600. Site plan review for a garage conversion. Motion to approve subject to Staff’s recommendations to include a 5’ setback by Mr. Brady, seconded by Ms. Hegedus and the vote was unanimous in favor of the Motion.

        5. PZ-5-24-18-40 940 NE 99th Street, (Applicant) Victor Mayorga, (Agent) None; Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations, Sec. 504. (f), (g) (2) and Sec. 600. Site plan review for a garage conversion for a bathroom and walk in closet.Motion to approve subject to Staff’s recommendations to include a 5’ setback and for the Architect to change the sizes of the windows to match the master bedroom by Ms. Hegedus, seconded by Mr. Snow and the vote was unanimous in favor of the Motion.

        6. PZ-5-24-18-41 87 NW 100 Terrace. Juan and Charrisse Nadal (Owners), have filed an application for site plan review before the Planning Board on the above property. The applicant seeks approval: Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations and Sec. 600. Site plan review for two additions. Motion to approve subject to Staff’s recommendations, with a covenant that the declaration of use is assuring the property is only used for single family purposes, the owner will be required to record this with Miami Dade County and provide a copy to Staff prior to final inspection by Ms. Hegedus, seconded by Mr. Brady and the vote was unanimous in favor of the Motion.

        7. PZ-5-24-18-42 9600 NE 2nd Avenue, (Owner) Palazzo Leoni, (Applicant) Medi-Station, (Agent) None; Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations, Sec. 504. (f), (g) (2) and Sec. 600. Site plan review and approval required. Signs. Motion to approve subject to Staff’s recommendations by Mr. Brady, seconded by Mr. Snow and the vote was approved 4-0. Ms. Hegedus excused herself.

        8. PZ-5-24-18-43 1158 NE 99th Street. Susan Pinnas (Owner), has filed an application for site plan review before the Planning Board on the above property. The applicant seeks approval: Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations and Sec. 600. Site plan review for two additions at the rear of the property totaling 700 sq feet. Motion to approve subject to Staff’s recommendations, with a covenant that the declaration of use is assuring the property is only used for single family purposes, the owner will be required to record this with Miami Dade County and provide a copy to Staff prior to final inspection by Mr. Brady, seconded by Mr. Snow and the vote was unanimous in favor of the Motion.

        9. PZ-5-24-18-44 : 1240 NE 91st Terrace, (Owner) Daniel Ocariz, has filed an application for site plan review before the Planning Board on the above property. The applicant seeks approval: Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations and Sec. 600. Exterior renovation (entry feature).Motion to approve subject to Staff’s recommendations by Mr. Bergman, seconded by Ms. Hegedus and the vote was unanimous in favor of the Motion.

        10. PZ-5-24-18-45 : 1079 NE 96th Street, (Owner) Jonathan Feldman, has filed an application for site plan review before the Planning Board on the above property. The applicant seeks approval: Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations and Sec. 600. Exterior renovation (entry feature).Motion to approve subject to Staff’s recommendations by Mr. Snow, seconded by Mr. Bergman and the vote was unanimous in favor of the Motion.

        11. PZ-5-24-18-46: 142 NW 101, (Owner) Sekou Caldwell, (Applicant) Same, (Agent) Marc Cambell; Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations, Sec. 504. (f), (g) (2) and Sec. 600. Site plan review and approval for a secondary structure. Motion to approve subject to Staff’s recommendations, with a covenant that the declaration of use is assuring the property is only used for single family purposes, the owner will be required to record this with Miami Dade County and provide a copy to Staff prior to final inspection by Mr. Snow, seconded by Mr. Bergman and the vote was unanimous in favor of the Motion.

      4. CONTINUED ITEMS
        1. Fences Walls and Hedges in front yards’ adjacent parks

          Mr. Travis Kendall gave a brief introduction of the item and recommended approval by the Board.

          The Board asked questions and made comments.

          Mr. Brady made it clear that he is against this Ordinance and he expressed his opinion.

          Mr. Snow spoke in favor of the Ordinance.

          The Board Voted to pass the Ordinance 4-1 with Mr. Brady voting against it.

        2. Rear additions of less than 400 square feet shall not require Planning and Zoning Approval.

          Mr. Travis Kendall introduced the item and mentioned section 4.10 he proposed to delete some of the verbage in it. Under #2. Additions to dwellings for the record it says: “site plan reviews approval by the Planning Board will be required for the following.” It will be any additions to dwelling. The verbage that should be added “greater than 400 square feet in size or which are locate in a garage” Staff would like the following added: “and is located at the rear of the property”

          Ms. Hegedus read into the record: “Site plan review and approval by the Planning Board is required for the following” #2 rear additions greater than 400 need to be reviewed. Ms. Hegedus spoke about wording on the Ordinance that need revision. There was discussion by the Board at this time. Ms. Hegedus and Mr. Busta would like to review any additions to the front of the property.

          Mr. Kendall proposed language to say: Site plan review and approval by the Planning Board is required for all additions. Except rear additions less than than 400 square feet not visible from the public right of way, except alleyways.

          Garage conversion of any type are to be reviewed by the Board.

          Chairman Busta requested the Legal Department to weigh in on this issue.

          The Board Voted to pass the Ordinance Unanimously.

        3. Finished Floor elevations shall be measured from the minimum FEMA floodplain elevation requirement in determining maximum permitted height. Reduction of the maximum permitted height in VE 11 zones to from 37(currently) to 30, and clarify the code to read the maximum permitted height in a residential district is 2 stories not to exceed thirty feet.

          Mr. Travis Kendall spoke about Section 508 and gave more details to the Board about the proposed Ordinance.

          The Board asked questions.

          The Board Voted to pass the Ordinance Unanimously.

  5. PUBLIC HEARING ITEMS
  6. DISCUSSION – There was discussion about generators by the Board and Staff.

  7. NEXT REGULAR BOARD HEARING – June 21, 2018.
