Background

 

The applicant is proposing to locate a pool chemical store within the Shores Square shopping center.  The store will occupy 2 storefronts in the mall.  The 2,124 square foot space was previously occupied by a take out restaurant and a tutoring company

 

The change of use does not require an increase in parking.

 

The operation will sell pool, patio and spa supplies including chemicals.  The operation will  include 2 1000 gallon chlorine tanks that will be housed inside the retail space.  The chemical storage will have to comply with all building code requirements.

 

The business as proposed is a retail store and no pool maintenance trucks will be operated by the store from the mall property.

 

The applicant has provided a Hazard Communications Plan and Emergency Response Plan.

 

Analysis

 

The proposed use is retail in nature.  All storage will be inside the store.

 

The property owner is working with Miami Dade County to extend sanitary sewer to the site and to connect the building to the Miami Dade sewer service.

 

The proposal is consistent with the technical provisions of the Zoning Code.

 

Recommendation

 

Planning and Zoning staff recommends APPROVAL of the site plan for a 2,124 square foot retail pool, patio and spa store with internal storage of all chemicals, supplies and products with a finding that it is consistent with the technical provisions of the Code.  However, the Planning Board must make a finding that the proposed improvements are harmonious with the community, as required in Section 523 of the Code and, in that regard, may add further conditions or delete or modify staff recommended conditions, deny the application, or continue the item for future consideration.  Should the board find that the applicant merits approval, staff recommends that the following conditions apply:

 

1)      Approval is for a 2,124 square foot retail pool, patio and spa store with internal storage of all chemicals, supplies and products.

2)      No pool maintenance trucks to be operated by the store from the mall property.

3)      Applicant to obtain all required building permits before beginning work.

4)      Applicant to meet all applicable code provisions at the time of permitting.

5)      This zoning permit will lapse and become invalid unless the work for which it was approved is started within one (1) year of the signing of the development order by the board chair, or if the work authorized by it is suspended or abandoned for a period of at least one (1) year.
