Background

 

The signage has already been installed.

 

Applicant is requesting approval for an internally lighted  box sign on the front wall of a storefront on NE 6th Avenue.  The top half of the sign is red with white lettering, the lower half of the sign is white with black lettering.

 

The applicant is requesting approval for window signage on the door and windows consisting of black lettering..

 

The storefront has approximately 12.5 feet of frontage.  The B-2 District provides for 3 square feet of sign area per building front foot giving the storefront a sign allocation of 37.5 square feet.

 

The proposed sign is 1.5 feet in feet in height and 8 feet in width. [1.5 feet X 8 feet = 12 square feet].

 

The northerly window sign is 3.5 feet in height and 3.25 feet in width. [3.5 feet X 3.25 feet = 11.37 square feet].

 

The southerly window sing is 4.25 feet in height and 3.25 feet in width. [4.25 feet X 3.25 feet = 13.81 square feet].

 

The total area for the two window signs is 25.18 square feet.

 

The door sign is 2.5 feet in height and 2 feet in width. [2.5 feet X 2 feet = 4.4 square feet].

 

The total area of all signage is 41.58 square feet.

 

Analysis

 

The applicant has a sign allocation of 37.5 feet and has 41.58 square feet of signage.  The applicant exceeds the sign allocation for the storefront by 4.08 square feet.

 

The proposal is not consistent with the technical provisions of the Zoning Code.  It is recommended that the applicant consider removing 4 square feet of signage in order to comply with the area limitation for signs.

 

Recommendation

 

Planning and Zoning staff recommends DENIAL of the site plan for signage with a finding that it is not consistent with the technical provisions of the Code.  However, the Planning Board must make a finding that the proposed improvements are harmonious with the community, as required in Section 523 of the Code and, in that regard, may add further conditions or delete or modify staff recommended conditions, deny the application, or continue the item for future consideration.  Should the board find that the applicant merits approval, staff recommends that the following conditions apply:

 

1)      Applicant to obtain all required building permits.

2)      Applicant to comply with all applicable code provisions at the time of permitting.

3)      This zoning permit will lapse and become invalid unless the work for which it was approved is started within one (1) year of the signing of the development order by the board chair, or if the work authorized by it is suspended or abandoned for a period of at least one (1) year.
