Background

 

The applicant is proposing to locate a Starbucks corporate identification sign at the rear of the building.

 

The 4 square foot sign is white with a green background.

 

The property owner entered into a Master Sign Agreement with the Village. The proposed sign is not consistent with the Master Sign Agreement and therefore the applicant must apply to the Planning Board for approval of the proposed sign.

 

Analysis

 

The sign is for an existing restaurant that is a permitted use in the B-1 Distinct.

 

The sign is located high on the wall at the rear of the building. Signs are not permitted on the rear of buildings except signs for identification purposes only with letters not to exceed six inches in height as regulated under Sec. 505 (k).

 

The proposal is not consistent with the technical provisions of the Zoning Code.

 

Recommendation

 

In acting on a site plan, the Planning Board must make a finding that the proposed improvements are harmonious with the community, as required in Articles V and VI of Appendix A Zoning of the Code of Ordinances, and, in that regard, may add further conditions or delete or modify staff recommended conditions, deny the application, or continue the item for future consideration.

 

Planning and Zoning staff recommends DENIAL of the site plan for 4 square feet of signage at the rear of the building with a finding that the sign is not consistent with the technical provisions of the Code.

 

Should the board find that the applicant merits approval, staff recommends that the following conditions apply:

 

  1. Applicant to meet all applicable code provisions at the time of permitting.
  2. Applicant to obtain all required building permits before beginning work.
  3. Approval is for 4 square feet of signage submitted with this application and made a part of the record.
  4. This zoning permit will lapse and become invalid unless the work for which it was approved is started within one (1) year of the signing of the development order by the board chair, or if the work authorized by it is suspended or abandoned for a period of at least one (1) year.
